Terms of Service

These Terms of Service ("Terms") govern your access to and use of the OneGaman pre-launch website, currently hosted at onegaman.com and any related domains (the "Website"). The Website is operated by Pushpander Singh Tanwar, an individual based in Delhi, India ("OneGaman", "we", "us").

By accessing the Website or submitting your email to our waitlist, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

These Terms form a binding contract between you and OneGaman under the Indian Contract Act, 1872, and Section 10A of the Information Technology Act, 2000.

The Website is a pre-launch information page for an upcoming Indian travel-intelligence mobile application. Its current purpose is to introduce the OneGaman project, share editorial content about our positioning, and allow interested individuals to register their email addresses on our waitlist.

The OneGaman mobile application has not yet launched. You cannot currently book travel, compare prices, or use any travel-related service through this Website. When the app launches, separate Terms of Service and Privacy Policy will govern its use.

OneGaman is not a travel agent, online travel agency (OTA), IRCTC authorized service provider, IATA-accredited agent, or IRDAI-registered insurance distributor. We do not process payments, issue tickets, or facilitate any travel transaction on this Website.

You may use this Website only if you are at least 18 years old and have the legal capacity to enter into a binding contract under Indian law. By using the Website or registering for the waitlist, you represent that you meet these requirements.

You agree NOT to:

• Use the Website for any unlawful purpose or in violation of any applicable law.
• Attempt to scrape, copy, modify, decompile, reverse engineer, or interfere with the Website or its underlying software.
• Use bots, scrapers, automated agents, or any automated tool to access or extract data from the Website.
• Submit false, misleading, or fraudulent information to the waitlist form.
• Use the Website to harass, abuse, defame, threaten, or impersonate any person or entity.
• Attempt to gain unauthorized access to our systems, accounts, or infrastructure.
• Transmit any virus, malware, or harmful code to the Website.

Violation of this section may result in immediate suspension of your waitlist registration and may, where appropriate, lead to legal action.

Joining the OneGaman waitlist does not guarantee early access to, or any specific entitlement in, the OneGaman mobile application when it launches. We may, at our sole discretion, offer early access, founding-member benefits, or other features to some or all waitlist members based on launch timing, available capacity, and other factors.

You may unsubscribe from the waitlist at any time by emailing contact@onegaman.com or by using the unsubscribe link in any communication we send you.

All content on the Website — including text, design, the OneGaman name and logo (the OG mark, the wordmark, and any combined lockups), the brand color system, our editorial copy, and the underlying software — is the exclusive property of Pushpander Singh Tanwar (and any future OneGaman corporate entity, on assignment) and is protected by Indian copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, modify, distribute, or create derivative works from any of our content without our prior written permission, except for personal, non-commercial purposes such as sharing a link to the Website on social media.

Where we reference third-party brand names (airlines, hotels, online travel agencies, etc.) in our content, such references are made under nominative fair use principles under Section 30 of the Trade Marks Act, 1999, and are intended solely to identify the entities being discussed. We claim no endorsement, affiliation, or sponsorship by any such third party.

The Website includes editorial commentary about the travel industry, including general statements about industry practices such as drip pricing, fake urgency, and pre-ticked add-ons. These statements reflect our opinion and analysis based on publicly available information, including the Central Consumer Protection Authority's Guidelines for Prevention and Regulation of Dark Patterns, 2023.

Where we reference specific companies or practices critically, we make factual claims based on publicly available information and our own research. If you believe any editorial content on the Website is inaccurate or misleading, please contact contact@onegaman.com and we will review the concern within 7 days.

The Website is provided "AS IS" and "AS AVAILABLE". To the maximum extent permitted by Indian law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of information.

We do not warrant that the Website will be uninterrupted, error-free, secure, or free of viruses. We may modify, suspend, or discontinue the Website at any time without notice.

Any information presented about future OneGaman product features, launch timelines, or commercial arrangements is preliminary and subject to change. Nothing on the Website constitutes a binding commitment by us to offer any particular feature, pricing, or timeline.

To the maximum extent permitted by Indian law, we are not liable for indirect, incidental, consequential, special, or punitive damages arising from or in connection with your use of the Website. We are not liable for loss of profits, revenue, business opportunities, data, or goodwill.

Our total aggregate liability to you for all claims arising from or related to the Website is limited to ₹1,000 (Rupees One Thousand only). This limit does not apply to liability that cannot be excluded under Indian law (including under the Consumer Protection Act, 2019), nor to death or personal injury caused by our gross negligence, nor to fraud or fraudulent misrepresentation.

You agree to defend, indemnify, and hold harmless OneGaman, its founder, future directors, officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from: (a) your violation of these Terms; (b) your violation of any law or third-party right; or (c) your misuse of the Website.

These Terms are governed by the laws of the Republic of India, without regard to conflict of laws principles.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Delhi, India.

Before initiating any legal proceedings, the parties shall attempt to resolve the dispute amicably by contacting contact@onegaman.com with a clear description of the issue. We will respond within 14 days.

We may update these Terms from time to time. Material changes will be notified by updating the "Last updated" date and, where significant, by email to waitlist members. Continued use of the Website after changes take effect indicates your acceptance of the updated Terms.

We may terminate your access to the Website (including removal from the waitlist) at any time and for any reason, including if we believe you have violated these Terms. You may stop using the Website at any time. Upon termination, the provisions of these Terms that by their nature should survive (including intellectual property, disclaimers, limitation of liability, governing law) will remain in effect.
